1. Acceptance of Terms

By booking services or using this website, you agree to these Terms & Conditions.

If you do not agree, do not use our services.

2. Scope of Services

Everest Home Services provides non-invasive cleaning services including:

  • Dryer vent cleaning

  • Air duct cleaning

  • Indoor air quality services

  • We do not guarantee specific energy savings, airflow improvements, or system performance outcomes.

3. No Guarantee of HVAC Performance

Customer acknowledges:

  • HVAC systems may have pre-existing defects

  • Hidden damage inside walls or duct systems may exist

  • Cleaning does not repair mechanical failures

  • Older systems may experience issues after service

  • Everest Home Services is not responsible for system failures resulting from pre-existing conditions.

4. Access & Property Conditions

Customer agrees to:

  • Provide safe and clear access to work areas

  • Disclose known system issues

  • Secure pets

  • Remove valuables from work areas

  • We are not liable for damage caused by undisclosed hazards or unsafe working conditions.

5. Payment Terms

Payment is due upon completion unless otherwise agreed.

Failure to pay may result in:

  • Collection action

  • Recovery of attorney fees

  • Interest charges permitted under Texas law

6. Cancellation Policy

24-hour notice required for cancellation

Same-day cancellations may incur a service fee

No-shows may be charged a trip fee

7. Limitation of Liability

To the maximum extent allowed by Texas law:

Everest Home Services shall not be liable for:

  • Indirect damages

  • Loss of use

  • Loss of income

  • Consequential damages

  • Mold-related claims

  • Fire-related claims unless directly caused by gross negligence

  • Total liability shall not exceed the amount paid for the service provided.

8. Indemnification

Customer agrees to indemnify and hold harmless Everest Home Services from any claims arising from:

  • Undisclosed system defects

  • Improper installation by third parties

  • Modifications made after service

  • Misuse of HVAC systems

9. Force Majeure

We are not liable for failure to perform due to:

  • Weather

  • Natural disasters

  • Supply chain interruptions

  • Power outages

  • Government restrictions

10. Dispute Resolution & Arbitration

Any dispute arising from services shall be resolved by binding arbitration in the State of Texas.

Customer waives the right to jury trial.

Each party shall bear its own legal fees unless otherwise determined by the arbitrator.

11. Governing Law

These Terms are governed by the laws of the State of Texas.

12. Intellectual Property

All website content, logos, branding, and materials are owned by Everest Home Services and may not be used without permission.

13. Entire Agreement

These Terms constitute the entire agreement between the customer and Everest Home Services.
